The Exception Test

The Exception Test applies in situations where the Sequential Test fails to produce compliance. It may be applied if:

• Highly vulnerable development cannot be located in Zone 1
• More vulnerable development cannot be located in Zone 1 or Zone 2

An application may pass the Exception Test if:

• The development makes a positive contribution to sustainable communities
• The development is on developable brownfield land
• Residual risks are proven to be acceptable and managed
• The development contributes to the reduction or management of flood risk
